Dear All,

I am an non EEA family member of an EEA national (unmarried partner), i was issued a residence card as a family member of an EEA national in April 2013 and its expiring in April 2018. I am hoping to make an application for PR on the basis of completing 5 years under the EEA regulations.
I have been living together with my partner since 2011 and we have 2 kids together.
My partner was issued a permanent residence document confirming that she acquired permanent residence in May 2016.

I have a few questions about my upcoming application and I will be really grateful if someone can respond please.

1. can i apply for PR 28 days before the expiry of the current EEA family permit or before ?
2. Do I have to provide payslips and proof extra to the home office for my partner showing that before she acquired permanent residence, she was exercising treaty rights?
3. Do I have to provide proof of her employment showing that she is still employed even after acquiring PR ?
4. Do I have to provide any proof that I have been employed ? before or after she acquired PR or its irrelevant?
5. what sort of documents do I have to provide to show that we have been living together? if i say bank statements, does it mean bank statements for each and every month from the past 5 years ?

1. No. I have read here you can *post* 1 day before you complete 5 years, so that they receive it on the day.
2. Have you already looked at the PR guidelines? If she has PR there is no need to send further documents. See page 12 of the guidelines*
3. No, she does not need to be employed once she has PR.
4. Your status is irrelevant. You have to provide evidence you have been together all this time though, similar to the evidence you had to provide for the RC but covering the last 5 years. Page 15 of the guidelines.
5. 1 per 12 month period, see table on page 9 of the guidelines for residence, page 15 for evidence of living together. I assume it is a joint bank account? Do you have any other documents under both of your names e.g. council tax, utility bill? You should also send the birth certificate of the children.

Have a look at the EEA(PR) form and guidance, it covers all these questions.

*Subsection A: evidence of the relevant EEA national’s activity as a qualified person
Please provide one of the following:
• your sponsor’s document certifying permanent residence if you answered ‘yes’ to question

• proof that you have/your sponsor has been a qualified person for the relevant period – see
below
