Tier 4 PBS Visa Refused. Administrative Review applied 28 days prior no reply yet.

Post by rajr2 » Fri Mar 09, 2018 9:13 am

Good day!
I am Rahul, writing this post in regards with the topic. I have followed this blog/website for advises and believe can expect good guidance. I have a query regarding the administrative review time period? I had applied for an administrative review with supporting cover letter and documents, and it has been 28 days since the application. I had applied the same outside UK from my home country, India. I had emailed them with the email provided and received a email straightway as a receipt that they have received the same. The details in brief are as below:

1) January 22nd 2018 received the refusal letter under 320 7(a) as not disclosing question number 28 of the application of staying 17 days prior to previous visa expiry (It was actually 27 days, wrong typed by the ECO). It was a clerical mistake and was not intentional as I had followed the visa dates than the stamp dates. I previously had 2 UK TIer 4 visa, American visit visa etc., where I gave dates of the visa dates rather the visa stamp dates. I discussed the same with a solicitor in India who advised me as a good chance to overturn it as it clearly looks like a clerical mistake from my side and an apology letter with clear documents highlighting the same, may be accepted by the reviewer.

2) After a huge discussion and research I prepared my Administrative form withe the help of a solicitor and applied for the same on 08/02/2018 (17 days after receiving the refusal). With clear cover letter accepting my mistake and pleading for overturning the ban if any, and a new application in future should be affected. I also added the reason for my stay i UK of 27 days prior to the visa expiry, which was due to an interview which I didnt want to miss and the guidance of the home office then who advised me on phone of stay for 28 days prior to visa expiry (though miss placed the reference number of the phone call and also no written evidence from Home office) I didn't want to breach the 28 days time period and voluntarily returned home.
3) Today! 09/03/2018 - It is has been 29 days since I sent for an administrative review, I have received no emails or phone calls prior the application. Neither I have received the refund for IHS. I refunded my University fees recently, as I will be able to join only for the next intake if possible, so decided to reapply to other University where the course was open for September intake/due to the uncertainty of the visa issue.
Can anyone please guide me, what should I expect from all these events? Should I be hopeful that the AR will be received soon and what to expect the outcome? Whom to contact to know the status? Will it effect for further applications? Or should I try other countries to pursue my masters? I really don't wish to waste time on this uncertainty, as I may lose other opportunities. I also wish to go back to UK and pursue my Masters there as my degree was undertaken from UK and preference for my masters is in UK. I am totally confused at this stage hope the reader can understand.
Kindly please guide me with the same, what to expect and the best remedy. Like mentioned I have followed this blog/website closely for sending my applications, I really would like to receive a guidance for the same.
Hope to receive an advice soon.
Regards
Rahul

Your solicitor?

Thank you for your reply,
Well they are not sure why it has exceeded the time period. They where suggesting to wait for the AR as they are confident the ban if any will be lifted, but I am confused as to wait for the outcome or try something new. What if the AR is not considered. So thought of putting on here for a guidance or advice, as i believe there might be people here who had similar issues or maybe got an idea with this?
Can I apply for a fresh visa application during this time, with the issue and the evidence of the previous fault (mentioned for refusal) on application, as I honestly did the fault by mistakenly, and did not do it purpose. Like mentioned I also have the reason (emails from the employer, where I had the interview) for my overstay. The only issue is I don't have the reference number of my call to home office I made about the 28 days timeline. Because they clearly mentioned on phone that I may stay for 28 days and a stay over 90 days without voluntarily leaving may result to overstay issues. It was completely my clerical error as I followed the dates on the visa and not the arrival/ departure stamps.
Please guide me for the same. I really wish to do a masters degree abroad and hopefully try this September intake. UK being a preference as my B.Eng was done there and wish to do masters supporting the same course. I have been following the other 320 7(a) issues before and feel really worried, cause I didn't do anything intentionally it was a careless mistake.
Regards
Rahul
