Switching between FLR(M) and FLR(FP)

Hi all,

I'm British citizen and my wife was granted initial permit on 5 year route through spouse visa of british citizen.

When we applied for FLR(M) extension 2 years ago it was rejected due to non-satisfactory self-employment documents (despite meeting all requirements) and automatically switched to FLR(FP) 10-year route. They cited the fact that we had a child who was British citizen for that decision. Unfortunately, due to circumstances I was late to appeal and lost the right.

Within a few month, my wife will complete 5 year period and we'll need to apply again. I was wondering about my optoins:
1. From other posts it seems that it's possible to apply for the 5 year route FLR(M) again. However, will this application take into account previous years or will it start from day 0? All FLR(M) requirements were met during all period of stay and can be proven.
2. Currently, we'll have to wait another 5 year on FLR(FP). In such circumstances, are there any other ways to apply for settlement earlier than that?
3. Does 10-year period of the FLR(FP) permit mentioned above starts from the date of switch from 5 year route or it starts from the beginning of 5 year period?
