Working after leaving tier 2 visa sponsor

Post by Phil005 » Sun Mar 11, 2018 9:12 pm

I recently left my job as a staff nurse in January who was also my tier 2 visa sponsor. However, apart from that job, I do 20hours max of part time as an agency nurse. I have found a new job to sponsor me in 19th February. They processed my visa and I am currently waiting for the decision from home office.

However, I am concerned whether I will be granted an extension visa as I may have violated some rules by staying in the UK from the time I left my job in January until 23rd February when I got a new job and sponsor.

Also, I am concerned as I continued working as an agency nurse after I have left my previous sponsor. I just learned on the 27th Feb that working part time is not allowed as I was not with my previous sponsor anymore. As soon as I knew about it, I resigned from the agency. However, it concerns me as the home office might reject my extension application, press charges or worse, deport me back to my country.

I hope you can enlighten me with this issue. If only I knew I can't do part time after leaving my sponsor I wouldn't have worked. Thank you so much!

One of the conditions attached to doing supplementary work is that you must continue to work for your main sponsor. Like you have noted, staying in the UK for 1 month while changing to a new job wouldn't be a major concern but working for the agency after you have left your former job is.

You should also note that your visa might not be curtailed immediately you resigned, so it is possible that your old visa was still valid. However, you have still broken the rule for supplementary jobs. Obviously, UKVI can easily tell from your HMRC record that you were earning money elsewhere. only time will tell what the outcome will be.
I am not a lawyer and do not claim to be one. All my comments here are based on my opinions, experience and interpretation of the appropriate UKVI guidance documents and immigration rules.

Thank you so much for your response.
Do you know what might happen to me, to the agency or the new sponsor? Is there any possibility that this might be overlooked by the home office as this is a recent one and may not reflect in my tax record yet. I'm really scared to be banned from entering the uk or deported back. I really didn't know that I have violated and as soon as I knew I resigned. I hope there's a chance for me. Thank you so much for your answer!
