Any advice welcome.....please...
I am due to apply for ILr based on TIer 2 Gen-I think I have an issue with meeting the 5 years-please can someone review and comment?

Initial COS assigned 14 March 2013
COS expiry 9 June 2016
Visa application submitted late March 2013
Visa granted 7 may 2013
Visa expiry 3 April 2016

Extension COS assigned 8 March 2016
COS expiry. 1 April 2018
Visa application submitted 15 March 2016
Visa approved 12 April 2016
Visa expiry. 15 April 2018

Can I apply for my ILR on the 10 April?

This will be
27 days ahead of visa expiry
The COS will not be active- I understand this is problematic!!!!
This will be ahead of my visa expiry
This will mean I apply for ilr before reaching the full 5 years but within the 28 day allowance?!

It has been suggested that my employer may have to obtain and release a further cos for me in order to permit me to apply for ILR.

Extremely concerned and appreciate any guidance available.

You can apply on the 10th of April. You CoS is irrelevant.

Even though it expired and also even if I’ve not reached the 60 months yet? (Within 28 days)...? Is there anything specific written on this?

A CoS in itself grants no rights whatsoever. It is just a document that indicates your employer’s willingness to employ you and hence the basis for a Tier-2 Visa. A CoS if not used expires in 90 days. Your visa, when issued grants you the right to live and work in the U.K.

As your visa was issued on 07/05/2013, you’ll meet the residence requirement for ILR 28 days before 07/05/2018. Provided you entered the U.K. within 180 days from your initial visa issue date.
