ILR Application and Claiming Benefits

Post by Alihamza2016 » Thu Mar 15, 2018 12:12 pm

I need some help to clarify one important issue.

I am a British citizen and my wife is on FLR(FP) partner visa as Private life in the UK 10 years route. Her BRP card is stamped with "No Public funds" and her letter stated that "Under the Immigration rules you are not entitled to receive public funds to help meet your living costs (or those of any dependent)‎. In addition your SPONSOR is not entitled to claim or receive public funds on your BEHALF".

We have 2 british national childern and they were not included in the application.

We were also claiming more benefits at the time of FLR(FP) than now. Now I am claiming tax credits, child benefit and housing benefit. I provided my wife's visa and all other documents to the Council and told council that my wife is subject to immigration control but counncil advised me that its a legal requirement to add my wife in the claim as an household and I am the main claiment not my wife. My wife's details also added in tax credit claim as well.

Now I am going to apply my wife's ILR on the basis of 10 years long residency and SET(LR) does not ask any info for claiming benefits.

Please share some info what it means "In addition your SPONSOR is not entitled to claim or receive public funds on your BEHALF"?

Would there be any problem with her ILR application due to benefits?

Many thanks
