ILR on 10 year Basis

Dear All

I was given forum contact details by my friend and he highly recommended you in regards to my case ILR on Long term 10 year basis.


This is my first post. please see below attached all the information in regards to my Home office case.


1) I first entered the UK on ..... March 2008 with Valid leave to enter as a student until ....... November 2009.

2) I joined HM Forces on..... April 2009 and was exempt from immigration control.

3) I enlisted in the Army on ......April 2009 with the Royal ....... . After my initial training at ........ I trained with ....... Regt I did what is called Phase Two training with .......... Regt. I was with Royal .......s until i left the Army.

4) On ........July 2011 I was discharged from Army as a result of having Medically unfit.

5) I made an application for indefinite leave to remain on ......June 2011 before i was discharged from the Army.

6) The above application was refused by the decision dated ....... September 2011 . However was granted Discretionary Leave until .....October 2011.

7) On ..... October 2011 i made an application for extension of stay. This was refused on ......April 2012. I had an appeal against the refusal on the....t June 2012.

8) Mt appeal was dismissed by a determination dated .... July 2012. I made an application for permission to appeal the upper Tribunal and was granted permission top appeal to the upper Tribunal. My case heard before the Upper Tribunal on .....October 2012.

9) By a decision dated .....October 2012 the upper tribunal remitted my case back to the Secretary of State for the Home Department for new decision.

10) The Secretary of state made a decision on the ...... August 2013 to refused to grant me further leave to remain.

11) It is the decision of the .......August 2013 that i had appealed against now on .....February 2014 that i am waiting for Home office decision.


First Tier Tribunal decision in which the Judge has allow the appeal to the extent the appeal is remitted to the Secretary of State to consider the Home Office Police set out in Chapter 15 Section 2-A- person seeking settlement :HM Forces.

My solicitor has sent reminders to Home Office every six months asking about the update.

Solicitor also asked for subject access request (SAR) in ...May 2016. (Received and no decision has been made since then) , my solicitor up to date with the reminders.

A) Could you please advise me that as home office hasn't replied from last 4 years, so what is the next step can i take in regards to this matter,

Q 1) Now as am in this country from 10 years and i am eligible for ILR on long term basis , i asked my solicitor about the process and was advised :

a) I need Life in UK and B1 d an Passport

i have passed the Life in UK
but for B1 i need passport which is with Home office . its got expired now but was valid at the time of i submitted my case last time.

My solicitor has checked and confirmed that i am fulfilling all the requirements for 10 years ILR.

Solicitor has advised that will send the file with LIFE in UK cert , as i haven't got B1 cert , i have to apply for new passport and when i will get the passport file reference number Solicitor will send my file , as soon as i will get my new passport i will have to taken B1 exam and then with the extra fees i will upgrade to the fast track system.

I have seen in the board previous posts that as a HM forces member i do not need the B1 qualification? is it right? (please note that i was medically discharged) .


If yes then when can i apply and what documentation do i need.


and the most important one what will happen to my previous case if i will application .
