BNO to BC

Hi All
I have some questions about my situation,
I am a Chinese and born in the Netherlands on 1980 with a CUKC passport and a consular birth registration certificate. Both My parents and I have never acquired the Dutch citizenship and back to Hong Kong while I was around 1 year old. My father was born in Hong Kong and was a CUKC while I was born and became a BDTC on Sep 1983 and so on became a BNO because of 1997 handover. I was also became a BNO after my CUKC expired. I applied the registration as a BC few months ago and got refused lately because of my father was a CUKC and became a BDTC on Sep 1983. I am not totally understand why would it be. However, I am planning to apply again by using the Form EM. My question is, back to 2004 I tried to apply for a HKSAR passport in Hong Kong but got rejected verbally because I was born in the Netherlands, somehow I was able to obtained the HKSAR passport by providing my sister’s information. I assumed that I was not a Chinese citizen before 2004 due to the first rejection. Do I entitle to registration as a BC by the British Nationality Act (Hong Kong) 1997 - Form EM that I was not hold any other nationality on ‘the relevant day 04 Feb 1997’? I am also confused that sometime the guild says no other nationality on the relevant day, sometime it say have never held or hold other nationality. So if I can prove that I have no Chinese citizenship on the relevant day, am I entitled? And I also read the 1981 Act that relevant day is different which is some day in 2009. So, which one is cirrect? Thanks a lot!
