MN1 for a child born outside UK. Re: PR

Post by Maztinzt » Mon Mar 19, 2018 8:54 pm

Hello, I was wondering if you could help me with this.
I've gained British Citizenship by neutralisation in 2015.
My wife is EU national, holds PR from 2013.
Three of us moved to the UK in 2007. Our daughter was only 3 years old when we arrived to the UK.
Our daughter was born outside of UK in 2003, she holds EU pasport. She now 14 years old. She had been studying here starting from nursery up to now. Currently she is preparing for GCSE.
My question is: does she need PR before applying for BC?
It seems to me she does quality still( without the PR) as long as her one of parents is BC and other holds PR.
It's very confusing as I read the guidelines.
Advice please.
Thank you very much

I believe you can register her using form MN1 under section 3(1) "registration at discretion". If one parent is BC and the other has PR it's very likely that she will be granted citizenship.

I'm not a solicitor though.

PS. This is the list of documents you will need - I'm not sure if the child needs to have a PR document though - perhaps someone else can clarify. My child has it...

MN1 application signed by both parents
PR card(s) for parents
PR card for child
Letter from school to show that the child has been living in the UK
Full birth certificate (incl translation)
Child passport
Passports of both parents
Marriage certificate (if parents married; incl translation)

Thank you for your help.
I'm still not entirely sure, shall I go ahead and apply with MN1 under section 3/1. Or should we put it under different section?
Will I loose the total amount I've paid in, if our application gets refused? It's a lot of money to risk for... I think I should do some more research on it.

Registration under Section 3(1) is correct.

Suggest using NCS.
