Hello all,

This is my first post on this forum so I apologise if I make any errors or omit any rules. I am going to try to summarise my experience with UKVI and I hope anyone can advise on what to do given my circumstance.

I moved to the UK in 2009 aged 13 as a dependent on my Father who was completing his PhD at a university in Wales at the time. He frequently travelled as part of research for his thesis/consultancy business and as a result exceeded the out of country limit i.e. 180 days/2.5 years. He applied for ILR in February 2017 (a month before our BRP was set to expire). He was refused. He submitted an Administrative Review and the refusal was maintained. The final stage was to submit a Section 120 Reconsideration Application. With help of an Immigration Lawyer, he submitted this and my mother, siblings and I were included in it (the refusal letter explicitly stated that the decision affects all his dependents so this was the logical thing to do at the time). We have proof of the application, post office tracking evidence and proof the Home Office received and signed for it at the corresponding address. UKVI are yet to confirm this application nor give a decision.

Six months passed, I had to take a year out of university and decline an internship offer as any checks carried out to verify my status under the Reconsideration Application came back negative. The Home Office claim to have not received any further application or appeals after the ILR was rejected. After much deliberation, I was advised to separate as a dependent and submit a separate application under FLR(FP). This was submitted in January 2018. I was offered another internship in March 2018 and an ECS check came back negative again.

I spoke with the UKVI Customer Service, explained my situation and was told to write to the Sheffield office where the caseworker on my case was situated. Apparently the caseworker is the only person with the power to overturn the ECS check. I sent the letter by first class post two weeks ago. My Local MP also wrote to the Home Office to further explain my situation (two weeks ago) and I am yet to receive any response.

Unfortunately, the company offering the internship will have to pull their offer soon. I was told FLR(FP) takes six months to conclude. It is incredibly unfair having lived and studied in the UK for a long period to be subject to this. I have no means to support myself, my parents have spent a fortune on application, legal and university fees on my siblings and I. Having a job to support myself and ease the burden on them is the least I can do.

I have been forced out of studying and working for almost a year. I am starting to suffer from depressive thoughts and anxiety due to the stress and lack of sleep. I honestly have no idea what to do and I hope anyone can help suggest any course of action that I could pursue.

Just read your post KlintonolaJ and I know how frustrating it could be. I do not have expertise advise about your case however don’t give up! I hope one of the experienced people here will post a reply. Pls keep holding on.
