Hi everyone!
(Tier 1 Entrepreneur Dependent)
Recently my wife changed her surname from her father's to my name, my question is which form is correct MCC or TOC if I use MCC then on BRP her old surname will appear & if I use TOC then we have to pay fee & have to wait as well, but we are not planning to travel soon & her visa is expiring on 18th November 2018, how early she can apply for extension to avoid paying TOC fee, that way she can change her surname on BRP when she will apply for extension.
Any advice on this what should she do?
Note: she is completing her 5 years in March 2019 she have to apply one more extension anyways.

Just send form MCC and wait until her next extension in which you attach a copy of the deed poll

Thanks Zimba for replying can you please confirm isn't it not necessary to apply for new BRP after changing surname within 3 months? I was reading this:
Changes to your name or personal details
You must apply for a new BRP straight away if any of these things change:

name, for example if you’ve got married
nationality
facial appearance
date of birth, for example if it was wrong
gender
How you report the change and apply for a new BRP depends on whether you have:

permission to stay in the UK temporarily (‘leave to remain’)
permission to settle in the UK (‘indefinite leave to remain’)
You must apply for a new BRP within 3 months. You can be fined up to £1,000 or have your stay shortened if you don’t.

You can apply for BRP directly however the waiting time is at least 6 months

I mean to ask if its not necessary to apply BRP now then I will just send them MCC form with deeds poll copy but if its necessary then i will apply now to avoid any fine. Can you please confirm how early she can apply for her extension before her visa expire?

I already applied for ILR on 5years basis waiting for outcome but she will complete her 5 years in March 2019 & her last extension is expiring in 18th November 2018, therefore she need one more extension to complete her 5years & that will be for 3 years I was thinking if only sending MCC form with deed poll is enough then why should I pay & wait sending TOC form we don't have any plans to travel soon & then she can apply directly for extension with her new surname.

Dear Zimba I think by mistake you shared the wrong link we can't use brp-rc-form to change name on brp that is toc, anyways thanks for replying.

Report a change of circumstances if you have a visa or BRP.
1. For Which Applications Must You Use Form Toc?
Form TOC must be used if you already have Permission to remain in the UK for a limited period as confirmed in a passport or other document issued to you, and
• you now want that status confirmed on a Biometric Residence Permit (BRP).
• you have changed your name, nationality, appearance, date of birth or your gender.
