please help! My ILR premium application.

please help! My ILR premium application.

Plse I will b grateful if someone can Suggest something. I have completed my 6 yr DL and applied for ILR through premium service. I went for appointment yesterday but the case worker says she can not make a decision untill I submit a valid passport. My passport was missing even before I was granted my first DL. But yesterday the case worker insisted that I have to go to my high commission and apply for a passport and send her the confirmation befor 10 days. My solicitor tried to explain to her that I have other forms of ID which I have submitted but for some reason she is insisting on me getting a passport from my high commission. Though they have never insisted on my presenting a passport when my DLs were granted.

Hi why where u granted DLR in the first place?

I made an Asylum claim, it was refused but 3 yrs DL was granted outside immigration rules. After that another 3 yrs DL was granted which is meant to expire on 30th March 2018. My two children who were my dependents on my Asylum claim are now British citizens ( ages 12 yrs and 11 yrs old).

Does anyone have an idea how long it takes for a decision? I went for ILR premium service on 22/3/18 after completing 6yrs DL after failed asylum case. After checking my documents for ILR application, the case worker insisted that I need to go and apply for a passport from my high commission and submit proof within 10 days. She also refused to acknowledge that I have applied for ILR. I sent her the proof on 27/3/2018 but have not heard anything since. Not even an acknowledgement letter to show that I applied for ILR. I was granted DL twice without a passport. I don’t know why it’s now a problem. And I payed for premium service. Does anyone know how long it could take for me to get a reply. I’m so worried.

My understanding is for an application of ILR a current passport is required as part of the application process, although you where on the route of DL and a passport for renewals was not required, it may be for ILR, my understanding is, there are only some exemptions made from 6 years DLR to when applying for ILR, such as language and financial requirements (although maintenance is still applicable).

Not only that you were refused asylum meaning that UKVI/H.O at the time of grant of DL on their balance of probabilities thought you did not qualify for asylum and must have granted you under either private or family life at that time.

Normally if you are granted asylum, then it is understandable that attaining a passport from your home country embassy/consulate or not having one for further applications is acceptable. In this case the caseworker seems to think that a valid passport should have applied to you and unless you provided any explanation or evidence to state otherwise.

I would also like to state, the caseworker can apply discretion to disregard you requiring a valid passport as part of your application.

Was their any reason why you couldn't apply for your passport beforehand? I understand it was missing but was there any obstacles preventing you from applying for a new one? If so, did you state those reasons in your application? Again, you where refused asylum, so you wouldnt be refused or prevented from applying for a new one at your embassy or consulate.

Keep your receipt of the documents you sent as proof you sent it within the 10 days given to you and maybe instruct your solicitor to write to UKVI in Regards to the application attaching a copy of the receipt.
