Hello,
I’m in Tier 2 ICT dependent visa under my husband. No possibility for his expeditions and he has to be in cooking period now. The visa expires in June 2018.
My current employer is willing to sponsor my Tier 2 General visa and is been applying for restricted COS from December 2017 & every month till now. Unfortunately my COS is being rejected due to monthly allocations caps. My situation is, I’m Expecting and have made a call to go back to India for Maternity/delivery. My question is
1. Can my company keep applying for COS though I will be in India for my maternity or is there any limitations how many times to apply?
2. Can I still remain employed by my employer though my visa expires in June while they are applying for COS until I get it, & come back to UK with family as my dependents? Is it legal to remain employed?
3. Any other options / suggestions plz?
