Tier 2 point based calculation

Post by Alfonsooo » Mon Mar 26, 2018 3:15 pm

Hi all, need urgent help in calculation of my points for tier 2, as I don't know which categories I fall under...

My status:
MSc graduate finishing study in Oct 2017 with my tier 4 visa expiring in Feb 2018;

Early this year, I got an internship with Tier 5 sponsorship valid from Jan 2018-Jan 2019; and I did the in-country application (from Tier 4 to Tier 5);

Meanwhile, I applied for a graduate scheme in an international bank and received the offer--graduate position starting from September 2018.

My question is: how many points do I earn based on the current point-based calculation?
I understand I need a RCOS and need to pass the RLMT, which is 20 points; but does my situation also suit to "Residential market test met by "milkround" and the individual being sponsored meets the requirements of paragraph 245HD(d) (other than he will be applying for entry clearance rather than leave to remain)". Because in this case, I would have 30 points other than 20.
(The term is referred from Immigration Rules --Tier 2 (General) limit: https://www.gov.uk/guidance/immigration ... attributes)

Now i'm pretty sure the recruitment process was a "milkround" after checking relevant document; but i'm confused if I meets the requirement in the "post study work"provisions.

So when I checked the 245HD(d) (see link here: https://www.gov.uk/guidance/immigration ... alreligion), in (d)(iii) it says:

(iii) The applicant must have studied the course referred to in (d)(i) during:
(1) his last grant of leave, or
(2) a period of continuous leave which includes his last grant of leave, (for these purposes continuous leave will not be considered to have been broken if any of the circumstances set out in paragraphs 245AAA(a)(i) to (iii) of these Rules apply or where the applicant has spent time with valid leave in the Bailiwick of Guernsey, the Bailiwick of Jersey or the Isle of Man in a category equivalent to any of the categories set out in (b)(i) or (ii).).

As my last grant of leave was Tier 4, and I switched to Tier 5 in country, so am I on a period of continuous leave which includes my last grant of leave(tier 4-tier5)? In this case, can I say I satisfy the requirement of "post study work"?

I know it's a long question, but it's really important to help me calculate my points correctly. Any ideas appreciated! Thanks a lot!

I really don't understand your question regarding the first bit. If you get assigned a COS, restricted or unrestricted, you get 30 points, where are the 20 points from??? I don't think you satisfy the requirement of Post Study Work, either
