Hong Kong single mother of a British child

Post by Bezzybeeee » Thu Mar 29, 2018 4:15 pm

Hi everyone I really appreciate if anyone here could give some advice on this...My daughter is British passport holder 4 years old. She is a British citizen but we always live in Hong Kong. And I m a HK passport holder. Got sole responsibility after the divorce with her British father. I'm financially healthy which I meet the financial requirement. We are living in hk and now planning to live in the uk so she can be educated there. Am I qualify to apply for some sort of visa so I could go with her to the uk and settle down? Prefer to do it in hk first so we secure that before we move. Is this a slim chance or it should be ok? I'm only worry if I got rejected that will affect my immigration record as I travel to the uk for business regularly. Thanks in advance.

I don't think there is a solution like the one you're looking for... The HO would refuse your application because they would argue your family life would continue outside the UK as it has done for the last 4 years of your child's life.

I don't see a basis for you to apply for settlement.

The question is about a British child who is entitled to live, study and benefit from hospital and medical in the UK.
Unfortunately there is not facility to apply from abroad, but you may be able to do so if you and the child are in the UK.

Did your family register as British citizens prior to 1997?

But even if the family registered, the children cannot automatically qualify, unless the children resided in Hong Kong in February 1997 aswell.

I have a troubling case of a Pakistani guys whose father was able to register as British but he was not unfortunately. I really dont understand why the British government cannot extend the provisions to the children of these people irrespective of where they were born or resided in February 1997.

My guess is that she was born prior to 1997 as she has a 4-year old daughter.
