Overstayed spousal visa for 6 years, urgent advice needed.

Post by Abul786 » Thu Mar 29, 2018 6:27 pm

My wife’s spousal visa expires before we do the application extension after 2.5 years this sept 2018 .. would that be a problem .. is there any ways we can do the application say like 2 months late as we would have the 6 months payslip then . The reason being is I would change job within prior to the 6 months application Period. Hope someone can help . I’m sure if people can’t do it on time before the visa expire there should a way .

Your post has been split to your own topic from the other member's thread you had tagged your question onto. Apart from your situation being completely different, posting in another member's topic is unfair and causes confusion.

No. It would be Inadvisable to apply two months late due to
E-LTRP.2.2. The applicant must not be in the UK – wrote:(b) in breach of immigration laws (except that, where paragraph 39E of these Rules applies, any current period of overstaying will be disregarded), unless paragraph EX.1. applies.
