Tier 2: ILR after gaps between jobs of more than 60 days

Post by Sergino » Thu Mar 29, 2018 10:27 pm

Hi All,

I have just found out that Tier 2 migrants (like me) who had a break between jobs of more than 60 days now have a right to apply for indefinite leave to remain. If this is true, and the new rule applies from January 2018 - see solicitor weblink removed by moderator I would like to ask if anyone tested this rule in practice. I wonder if I need to extend Tier 2 visa in 2018 to be able to apply for ILR?

My UK immigration history is the following:

15.10.2013 - 14.01.2017 Tier 2 General visa (Employer #1)

30.12.2014 - Termination of employment (but no curtailment letter received)

30.12.2014 - 31.08.2015 Job seeking

01.09.2015 - 14.09.2018 Tier 2 General visa (current Employer #2)

Thank you in advance for comments and advice.

ILR application date - after Tier 2 General

Post by Sergino » Mon Apr 02, 2018 1:13 pm

It might be a basic question, but I would appreciate if anyone could advise.

My current Tier 2 General visa expires on 14.09.2018 which is just 3 days before the date I become eligible to apply for ILR (incl 28 days). Is there a way to avoid extending Tier 2 visa just for the sake of 3 days?

Thank you.
