PBS Dependents only applying - need help in section 6 for absences.

Post by user_name » Mon Apr 02, 2018 7:08 pm

Hi All,

Husband is already British citizen (via Tier 1 General 5 years and then ILR).

Wife and children are applying themselves for ILR now as PBS dependents.

Need some guidance in filling in SET (O) form.

Section 1 (page 9) has been filled with wife's details as main applicant. Children's details are filled in Section 2 (page 11 and 12) as dependents. Are these correct?

Then in Section 6.1, 6.2 (page 20), it asks for number of absences for the main applicant (dependent wife in my case). In this section, it does not say about the exclusion of absences for dependents for the leave granted before 11 Jan 2018. Should we declare absences here?

However in Sections 6.12, 6.13, 6.14 for dependents, it (6.13) clearly say to skip to the next section if the period of stay on which this application was based doesn't include any leave granted since 11 January 2018, so no need to declare absences. We have included children in here which is fine.

But not sure when should we include wife's details in terms of absences?
If we don't include wife in section 6.1, 6.2, then it contradicts with Section 1 where wife is given as main applicant (though PBS dependent actually).
But if we include wife in section 6.1,6.2, then need to declare absences (though not relevant actually), so will it likely to be taken as exceeding the allowed absences and hence could be a reason for rejection by the case worker?

Would you share your thoughts where to include wife in Section 6 please : 6.1/6.2 or 6.12/6.13?

Many Thanks.

Correct

Then in Section 6.1, 6.2 (page 20), it asks for number of absences for the main applicant (dependent wife in my case). In this section, it does not say about the exclusion of absences for dependents for the leave granted before 11 Jan 2018. Should we declare absences here?
Yes. You need to provide all the absences from the UK. But you need not provide any specific proof other than your passports and BRP. I also did the same for my wife's application. She had more than 180 days outside. No issues.

However in Sections 6.12, 6.13, 6.14 for dependents, it (6.13) clearly say to skip to the next section if the period of stay on which this application was based doesn't include any leave granted since 11 January 2018, so no need to declare absences. We have included children in here which is fine.
Perfectly fine. Here your wife is the main applicant.

But not sure when should we include wife's details in terms of absences?

I know it does not make much sense. But you need to provide the absences. It is bit mixed up now. Hopefully they will get this sorted in the next version.

Many Thanks.
