would Naturalisation invalidate ILR?

Post by Cidfen » Mon Apr 02, 2018 9:29 pm

Hi

appreciate if someone can suggest. I got the British citizenship 2 years ago but have not applied for British passport yet I used my old passport with ILR vignette to travel abroad.

Am I correct in thinking the ILR is still valid? Otherwise I won't be able to pass through the British boarder.

Or do the border officer already know I am a BC each time I show them the old passport with ILR (from their border system)?

So,

if I am now inviting family to visit UK (visitor visa) can I just supply my ILR to show my status of the right of staying in UK? would there be an issue by the local British embassy in my country?

I am not inclined to apply for british passport for now as I wont be travelling in the next couple of years hope it make sense.

Thanks for any suggestion. I checked online for a while but couldn't find a straight answer to this.

"would Naturalisation invalidate ILR?"
Yes.

Does the country of which you hold a passport allow dual nationality?

Your ILR became invalid as soon as you attended your Citizenship ceremony. You will be unable to sponsor your family for a visitor visa under your ILR as you no longer have it.

thanks for the quick response.

Do I need to supply the Citizenship certificate for family visitor visa when I don't have a British passport

So previously when traveled with old passport with ILR and the border officer just always know I am a BC and just keep silent?

A copy should suffice.

You should consider applying for a CoE-RoA to be placed in your non-British passport.

There is no requirement for a British citizen to enter on a British passport, but there have been reports of people in your position being told to get either a British passport or a CoE-RoA.

Hi
no it's not that, at the custom I went through the non-EU pass and the ILR was examined just like other visitors. neither mention BC nor was asked. If the ILR is invalid that wouldn't be the case. I can't imagine the home office does not share such info with custom.

Also I checked the possibilities to invalidate the ILR are: stay abroad over 2 yrs and criminal offense, nothing else I can find.

At Customs or Immigration?
Customs wouldn't care.

I think:
If Immigration wasn't aware that you are a British citizen, then they would consider if you satisfied the returning resident requirements, etc.
If Immigration confirms that you are a British citizen, then they cannot refuse you entry, unless you are subject to the Counter-Terrorism and Security Act 2015.

Hi

When you arrive UK the BC go thru a separated pass and no need to fill in a arrival card. While I went thru a different one with Non-BC. Does that make sense.

the above suggestion is not quite answering or show why ILR has been invalid.

With what I experienced the officer have checked ILR and stamp the passport and ask questions like how long have you live in UK and other simple ones like I was a visitors (which I was as I hold ILR as UK visa permit). this shows ILR is valid.
