Schengen information system

Post by Murad12 » Tue Apr 03, 2018 4:01 am

I'm a Ghanaian currently living in the Czech republic with my wife. I applied for asylum in 2014 in Finland but was sent to the Czech republic because of the Dublin law. I was told by the finish authorities I was banned from entering Finland for 2 years and then I was sent to Czech republic. Now I'm trying to apply for temporary residence but the law is I have to go to my home to apply for short stay and return. I was reading about the schengen information system on the internet since never knew anything about it so I asked a lawyer and was told the ban was being put on hold because I asked for asylum and it'd start to count when I leave the schengen territory. I asked another lawyer and she said not all bans are entered into the schengen information system system is that true? Also she asked me to request for my information from the schengen information system but I'm leaving the Czech republic in one week so don't have enough.
Does anyone have an idea concerning such cases?

Thank you

Although I am not an expert in the matters of asylum processes, I believe the second lawyer is right, not all bans are enforced by SIS, however, you should ask for SIS report from the finnish authorities. http://www.raja.fi/facts/schengen_infor ... tem_sis_ii

In case a SIS entry ban exist, unless the member state lifts the ban you cannot enter the whole of Schengen, you have the ask the initial member state to remove your ban or proceed legally. Good luck.
