Can I continue working for my current sponsor after receiving BRP from new sponsor?

Post by ideotea » Fri Feb 02, 2018 11:55 am

Hello all members,

My tier 2 with my current sponsor is going to expire 12 April 2018.
I have applied to extend my tier 2 visa with my new sponsor. The work in COS start on 1 April 2018. I have received my new BRP issued on 26 Jan 2018.

In this case, can I continue working with my current sponsor until the start work date with my new sponsor??

I saw the paragraph below and it sounds like my previous leave with my current sponsor is already expired? Is that right? Thank you very much for your help.

Paragraph 225

It is recommended that you do not start work for your sponsor until you have received your
biometric residence permit (BRP). However, on the basis of your approval letter, if you and your sponsor agree you can start work before you have your BRP, both you and your sponsor carry the risk of having no statutory excuse against a civil penalty if the BRP card is incorrect or withdrawn by us. You can continue working for your previous sponsor until the start date on your new Certificate of Sponsorship, provided your previous leave has not expired.

An additional question please,

As I'm going to start work with my new employer on 1 April 2018, will this effect my ILR application for 5-year tier 2 route?

Thank you very much.

Yes you can continue working for your previous employer until 31st March 2018. Your previous BRP would expire on 12 April 2018 wouldn't it, and it's 02 Feb 2018 today.

Any actions required for sponsor after I have granted my visa.

Post by ideotea » Wed Feb 14, 2018 10:19 am

Hello members,

Last month I have granted a tier 2 visa with my new sponsor. I am supposed to start working with them in the next two months. I have to send them a copy of my BRP so they can keep it.

1) Anything else should I send to my new employer before the start date?
2) Do my new sponsor have to update the sms system about me start working with them? (as I know that if the new employee cannot start work within 28 days, the sponsorship license will be revoked)
3) Are there any actions I should remind my new employer to do?
4) My company sponsored me as a foreigner for the first time. (They only applied for a license after they planned to hire me) When do we expect the home office to visit?

Thank you very much for your help.

COS start date is 1 Apr but cannot start until 3 Apr, need to inform HO?

Post by ideotea » Wed Mar 21, 2018 8:50 pm

Dear Member,

I have successfully applied for my visa with my new employer and already received my BRP. The start date on the COS is 1st April 2018. Due to the bank holiday, I will actually start working with my new employer on 3rd April 2018. Please let me know that in this case does my employer have to report this to the Home Office?

Thank you very much.

Does employer need to report HO that I started working with them today?

Post by ideotea » Tue Apr 03, 2018 2:30 pm

Dear Member,

Apology if you saw this question before.

I have successfully applied for my visa with my new employer and already received my BRP. The start date on the COS is 1st April 2018. Due to the bank holiday, today (03 Apr) is my first day working with my new employer, do my employer have to report the home office? Does my employer have to inform the home office (somehow) that I have started working with them today?

Thank you very much.
