FLR M Extension for my Spouse

FLR M Extension for my Spouse

Hi

i am really sorry if this question has already been asked in the forum and i did try searching for it but couldn't find anything related to my issue.

I am a British Citizen and my spouse has an Indian passport. She came on a spouse visa in Feb 2016 and have the residence permit which is due to expire in October 2018. I am aware from September 2018 onwards she will be eligible to apply for FLR M extension for another 2.5 years.We are planning to relocate to Australia at the end of this month ( April ) as i hold Australian permanent residency and she has dependent marriage visa.


Now, please see my list of queries.

1) if we move to Australia without applying for FLR M extension in UK, can she apply this from Australia? if yes, does she has to come back to UK personally to collect her biometric card or it could be delivered at a UK address and we can get it couriered.
2)If she doesn't apply for FLR extension and we come back to UK in 2-3 years time . Does she has to start the whole 5 years process again or she only has to apply for FLR extension for 2.5 years to be eligible for ILR?
3) If we stick around until September 2018 and apply for FLR M and then leave for Australia with the extension granted and come back after 2-3 years. Does she has to apply for 2.5 hrs extension or start the whole process of 5 years again?

No. FLR(M) can only applied for from within the UK.
2)If she doesn't apply for FLR extension and we come back to UK in 2-3 years time . Does she has to start the whole 5 years process again or she only has to apply for FLR extension for 2.5 years to be eligible for ILR? Yes, you will have to start the whole process again.
3) If we stick around until September 2018 and apply for FLR M and then leave for Australia with the extension granted and come back after 2-3 years. Does she has to apply for 2.5 hrs extension or start the whole process of 5 years again? Start the Spouse visa process again as her time in the UK will not be considered.
