Long Journey to ILR, Tier2_Sopnsor_Audited

Post by uktier414 » Fri Apr 06, 2018 12:44 pm

Hi

I hope all of you who stuck with UKVI pull through.

I have been following and reading threads on this forum for long time, I thought I will put my journey to ILR on here as it might help someone.

I have been on Tier2 since 2012, I qualified for ILR last year in August but there were few issues, when I first started my job my salary was was 21k then 25k and then got promotion to 36k in April last year (actually the salary not significantly changed but the working hours changes ). when I applied for ILR through same day service in August 2017, I have been handed a "further checks" letter, I thought this might be checking my bank statements or checking tax etc but no that was not the case, i searched on this forum and I found out that anyone who has increase in salary got the same issue.

Anyway in October(2 months after ILR appointment) we had UKVI unannounced visit, they questioned my sponosr for couple of hours and also interviewd me for 30 minutes.

I was expecting a quick result but unfortunately I had to to wait and in feburary (4 months from the Audit) we got positive feedback from UKVI (A rating maintained). I also rang and chase for update when 6 months completed but got the standard reply via email that "your applicatin is not yes completed", I also contacted my MP end of march and UKVI told my MP that I will be hearing from them shortly. so at the start of this month I have got my ILR approved.

I would suggest that anyone on Tier2 applying for ILR with salary increased shouldn't be worried if everything is genuine and the sponsor is following all the rules and guidlines then you will get ILR and in some case you have to wait for long time like 8 months in my case.

Hope this helps who are waiting or applying for thier ILRs.

congratulations
I am not a lawyer and do not claim to be one. All my comments here are based on my opinions, experience and interpretation of the appropriate UKVI guidance documents and immigration rules.

Hi,
I am in same boat could you please post here what questions compliance officer asked you and your employer?
Also you and your employer work in same building? Because my work location is about 173 miles away from my head office. so if they have to question me will UKVI inform me to come to head office ?

Thank you.

Hi sri

The compliance officer ask the questions from the book (i.e why salary increased, your contact details, contracts, payslips, why and when the change happend and did you update sms, if hours/salary changed dramatically then you should update,

He will ask you questions about your role and your history that when you got this job and how you got this and how your salary changed, In my case we don't have many staff in UK office, our staff are mainly oversease so there was no one to compare my salary or working hours with.

you can also look at this post
indefinite-leave-to-remain/ilr-on-hold- ... 26868.html

they will go thourgh the book and see if everything is genuine then you don't need to worry but you will have to wait for 6-8 months as they are very busy and it will take time.

if you are not present at the head office then they will book an appointment with you but they will see you for sure.

let me know if you have any questions.

Thanks
