Form SET(M) Question 7.6 and ILR

Hi,

I was wondering if anyone can guide on the following issue.

If the applicant says yes to the questions 7.6 on form SET(M) which asks Are you or your partner receiving any public funds?

Would the application be rejected?

The situation is that one of the child of the married couple is severly disable. The wife is a British National and receiving the following:

Carers allowance, Child Tax Credit and Severe Disablement allowance.

All the allowances come under the wife name.

The husband is not cliaming anything and paying for everything else from his job income.

The initial 2 years visa granted to the husband is finishing in July and he wants to apply for ILR and is not sure if he will face any problem because of the above.

Any gudiance will be highly appreciated.
