Promotion and Increase in salary ... Now What?

Hi,

I am on a Tier 2 visa issued in 2014.

My employers are intending to give me a promotion, which entails additional responsibilities (related to the job for which I had got my original Tier 2) and an increase in salary by around £7500.00

Would appreciate if someone can advise ... what are my legal responsibilities with regards to this promotion?
1. Do I need to get my employers to inform this to the Home Office by the SMS?

2. Does a promotion/allocation of additional duties in the same field ... require a new Resident Labour Test?

3. Anything else that I may need to be aware of.

Would like to state that my Job Title shall not change. It is just that due to my performance they would like to give me a promotion ... and entrust additional responsibilities.

Kindly advise.

Should ask in topic of Tier 2 PBS, but not here.

Cannot justify and no knowledge about your job, however for ILR salary threshold, a sudden huge increase in salary right before ILR application will alert HO. Honestly, such huge increase is very rare by promotion (especially no change on job title/ working place). Surely not 100%, but HO may interview you and your boss if they have any doubt when you apply ILR.

Hi!,

Your employer need to update about that on SMS and this additional duties you are mentioning will be a flag for HO for sure! Your job responsibility should be under the SOC code. You can't do any additional work/tasks....better not to mention this Phase..My Friends ILR held for a longer period just because he mentioned this additional responsibility thing!

I would suggest you ask your employer give a proper justification of your increment and must have to mention that your work will be under the specified soc code details.

Thanks for your replies.

GMO ... you stated that the 'additional responsibility' issue could create a problem. But what if the additional responsibilities fall under the same SOC code ... would it still create a problem?

What if my employer does not update it on the SMS ... as it is not a change of Job Title?

This will definitely be flagged by HO despite the fact that your ILR is still about a year away.
Can u state your job specifically so that you can be advised accordingly?
In my opinion, £7,500 increase without a change in job title but with additional responsibilities is strange. If not for any reason at least a senior in front of the title.
