separation from UK to a spouse from abroad

Post by Na5ir » Sun Apr 08, 2018 2:45 am

I am a British Citizen and I moved from UK to Sweden in 2014. I worked full time in Sweden for three years but I have moved back to UK permanently on October 2017. I invited my non-EU wife From Pakistan while I was in Sweden in 2015 and she applied for residence card which is valid from 2016 -04-19 to 2021-04-19. We have had a baby boy together in Sweden who has his British passport as well.

she came to UK with me on 6 months EU family permit however she stayed here for only three months.
We have been separated and she has gone back to Pakistan from past 7 months with our son who is British citizen.

my question is..

I no longer live in Sweden but my non EU wife still has her Swedish residence card until 2021 from , can she still travel to UK/Sweden on that card even though EU family member permit has expired for UK?

Why are you asking that question?

You planning on bringing your wife back to the Uk or have you split for good.

She cant make any threat against you, but she is entitled to enter the EU, and she is entitled to use her child who is British. You have no say in that matter. What should concern you, is her not using your relationship as a basis of stay or falsely assert you are living as a couple. If she want to come back, she is entitled to and you cannot stop her.

You need to focus on your future and how you can make a positive contribution towards your son and stop getting worked up on whether she comes to Europe or not.

you are absolutely correct in that, all i am concerned about is not to use my name because in future.

The residence card is issued as a EEA family member on my basis my dear Obi, if she comes back she is obviously going to be using that card because she doesnt have any other means at the moment. And in future, if i decide to remarry and she comes back and claim that she is my wife too, where do i stand. obviously, i will be in trouble.
