Switching to Tier 2 ICT dependent from Tier 2 ICT

Post by chetandvd » Mon Apr 09, 2018 6:32 pm

Hello everyone,

I would really appreciate your help with the situation that I'm in.

I'm on Tier 2 ICT Long term Visa (upto 3 years) valid until Apr 2019. I'm currently working in the UK.
My wife is also on Tier 2 ICT Long term Visa (upto 3 years) valid until Aug 2019. She's currently on maternity leave until Sept 2018 (Maternity leave extendable until Dec 2018). We both work for same employer.

There're serious doubts over my work contract extensions after Sept 2018 and there're slim chances for my wife as well for securing a contract once she's back from Maternity leave.

So I'm planning to switch my Visa Type from Tier 2 ICT into Tier 2 ICT dependent and hoping to find opportunities elsewhere as T2 ICT dependent can legally apply/work in other companies.

So my questions are -

1. I'm going to apply for T2 ICT dependent via priority servive. Could someone please let me know what all supporting documents will be needed? and whether all supporting documents will required to be sent in original or photocopies?

2. The minimum maintenance required for dependent. Now I see that, min £630 are needed in the account for minimum of 3 months. Being tied with few liabilities, it was not possible for me to have £600+ in my account for last 3 months. Same is the case with my wife's account, she's not been having more than £630 (for dependent; that's me) + £945 (for herself) supporting/minimum maintenance amount in her account. Also, since she's on Maternity Leave, she's already on a reduced pay since Jan 2018. But, her CoS (A listed sponsored) does mention "Y" for the field "Tick to confirm the sponsor certifies maintenance for the migrant" and the as per the "https://www.gov.uk/government/publicati ... rs-1-2-4-5" guideline number 99 and 100, sponsor can certify on the CoS itself about maintaining the Migrant + Dependents.

Further, I see below on link "https://assets.publishing.service.gov.u ... r_2017.pdf" -

"Tick to confirm the sponsor certifies maintenance for the migrant -
By ticking this box, you will also confirm that you are certifying
maintenance for any dependants of your sponsored migrant."

So is the above mentioned field ("Tick to confirm the sponsor certifies maintenance for the migrant") from CoS will take care of the any required maintenance for migrant and dependents as well? Or there's something else that is needed on the CoS? Or do my wife need to request her employer to provide a maintenance certificate for dependents? And if at all there're questions related for required maintenance of dependent are raised, is there any way I can show my salary income as a supporting document to highlight that even after becoming a dependent I'll continue to earn.

3. The fact that my wife is on Maternity leave, will it affect the validity of her CoS? meaning, will her CoS be still valid and I'll be able to make use of that CoS as a supporting document when applying for T2 ICT dependent Visa?

4. Can I continue working for my current employer even after switching my Visa into T2 ICT Dependent?

I would very much appreciate if you could answer above questions in whatever detailed way possible for you guys. Also, if you could mention any important things which might be worth noting for me such as cover letter, etc.

Thanks in advance!

Chetan.
