I have a question related to my relatives.
The man and his wife came to UK as refugees, the Husband is from Syria and the wife is holding a Jordanian passport. Nevertheless, the couple lived all their life in Syria. The wife never lived in Jordan.
When they arrived to the UK 3 years ago, the Husband was granted refugee leave as the main applicant, and the wife was granted Refugee Leave as well inline with the Husband's status.
2 years ago, the Husband passed away in the UK and the wife is left alone. Her Refugee Leave is still valid till 2020 May.
Note: Her children all live in the UK (under General Tier 2), she has got no one in Syria and no connections at all with Jordan except her passport. Her age at the time of ILR application will be 67.
Now the questions are:
- Can she apply for Home Office Travel Document instead of her Jordanian Passport, without any risks?
- When she applies for ILR should she apply as the main applicant and provide the Death Certificate or what?
- Is there any risk of her ILR getting rejected due to the death of the main applicant (refugee)?
