Tier 2 - ICT Cool off period

Post by sarantop » Thu Apr 12, 2018 2:59 pm

Hello,

I'm Indian national on Tier 2 ICT. Arrived here on Sep 2013 and expires by Sep 2018. I know there is cool off period of 12 months, before applying. My questions is:

1 - Is the cool off period applicable, even if i switch employment/employer?

Thanks
saravanan

Yes, unless your employer is paying you really high(£159,600)
Any suggestions I make in the forum are out my personal experience and should not be taken as a legal/professional advise.

Hi Saravanan,

Exactly I am in the same boat, one of my friend told that I can go back to India and can apply Tier 2 General through some other sponsorship but what I have seen in man y of the forums is there is a mandatory cooling period of 12 months which needs to be served.

So seems like all the doors is closed.
There is no guarantee that after 12 months cooling still the offer shall be hold good.
Fingers crossed.

Thanks,
Suneel

12 month Cooling period starts from the day you go back to home country, not from the day ur existing T2 VISA expiry. However if u choose to stay till the end of current VISA, then obviously 12 months from the date of expiry.

As Poper said, there is an exception that if ur prospective employer chose to pay 159K or above then no cooling period!
