Sickness benefits for wife with ILR (Spousal)

Post by skyscraper101 » Thu Apr 12, 2018 4:42 pm

My wife was granted ILR last month as the spouse of a British Citizen (me).

Her previous spousal visa stated 'no recourse to public funds' - but has that changed now she has ILR?

She has become unwell and will be unable to work for some time so I would like to investigate if she could get access to any out of work/sickness benefits but I'm unsure if would she even qualify? My limited reading suggests that she would still need to have 5 years in residence with ILR to claim any benefits. Can anyone clarify?

This may even mean in the long run it'd be cheaper to just apply for a full citizenship if that means access to sickness benefits can take effect. Thanks in advance.

Your wife is no longer under Immigration control and is entitled to claim sickness benefit and any other Public funds. There is no requirement to hold ILR for 5 years.

I hope is back in good health soon.
