Urgent help needed please.

Please help.

Received refusal from Home office on FLR (FP) application with out appeal right dated 11April. But on 6th I submitted a new variation FLR (FP) as my wife is pregnan5. They have deducted money £1986 o 10 April. So technically my old application voided on 6th April and they can't give the decision. My solicitors says to make a pre action protocol letter as it's a error of law made by home office.

My question is if I make PAP will my 10 years 3C will end? I a. I this country from January 2009 and from 2016 May making few applications which extended my 3c leave. I don't want to lose my 10 years now being this close.

Should I submit PAP or make a fresh application ( home office already have one application applied on 6 April).

Please advice.
