I require advice on a Tier 2 visa situation as I had a lapsed visa duration of about 2 weeks. I am unsure although I had a COS during that time, if that still qualifies for the 5 years continuous minimum requirement on Tier 2 for ILR. The information are as follows:
16 August 2016: Tier 2 Visa Expired (Old Job)
17 August 2016: Received confirmation that COS has been granted by home office for new position in the same firm
20 August 2016: Left UK and went home, Malaysia to apply for the visa
28 August 2016: Tier 2 Visa Application (remotely from Malaysia)
19 September 2016: Recieved Tier 2 Visa and BRP
The home office meeting to grant the restricted COS visa was on 12 August 2016 and I finally receive a confirmation of COS being granted on the 17th of August from HR. Does this mean that my Tier 2 (5 year requirement) is lapsed for ILR application? At the same time, does it also mean that I have overstayed from 17th August to 20th August?
Any help and advice is greatly appreciated.
