Uk Standard Visitor Visa Refusal

Post by Rikjavik » Thu Apr 12, 2018 11:17 pm

Hi all,

Thanks to all moderators and seniors for your help. We have resolved lot of issues on this forum previously.
I urgently need your help again.

I'm a British Citizen and work as an IT contractor. I applied for visit visa for my sister-in-law and it was refused on 2nd July 2017.

Her details and documents provided with the application:

Nationality: Pakistani
Age: 23yrs
Occupation time and duration at the time of application: School teacher (7 months), Payslips, Bank statements showing salary deposits, letter from her employer.

Sponsor details (myself):

1) Company documents / bank statements
2) Passport
3) Invitation/sponsor letter showing sufficient funds and accepting that I will fully pay for her visit including maintenance, accommodation, flight tickets, medical etc.

Her visa was refused under Paragraph v 4.2(a,c).

I tried to attach JPEG file of the refusal letter but it's not allowing. I will again.

As far as I understand, it was due to the unexplained funds deposited before her application (which I think was a really bad Idea and they should have not done this). Her father deposited around GBP 1600 so that she can do some shopping before her departure but unfortunately it became the reason for refusal.

Now, we are applying for her visa again. She is still employed as a school teacher with the same employer with little bit more income now. Now this time the bank statement just shows her salary and do not show any unexplained funds.

She doesn't have any savings as such so I will be fully supporting her.

Now we are applying again as its been a while and her bank statements are now straightforward i.e showing her salary deposits ONLY for last 6 months.

Do we need still to clarify about the unexplained funds (in the old refusal) in the new application that it was deposited by her father for shopping etc? There are no unexplained funds in the new bank statements. Or shall we completely forget about the old refusal and no need to explain the reasons?

The only thing that is different this time is a little bit increment in her salary with the same employer and a letter from her employer stating holidays etc. She doesnt have any property. She live with her two brothers and parents in the same house. Is there any thing else you could suggest? Do you think she stands a chance with this?

She doesn't have any savings as such so I will be fully supporting her.

She could be certainly refused again for the above reason. UKVI expects the applicants to showcase financial wellbeing though 100% sponsored.
WOuld be sensible to provide an explanation on the funds deposited by her father earlier.
A letter from her employer that she would return to work after the trip would help.

But I personally think without funds on her name, the chance for approval is very slim
Any suggestions I make in the forum are out my personal experience and should not be taken as a legal/professional advise.

Her visa was refused under Paragraph v 4.2(a,c).
They appear to doubt that she is a genuine visitor.

Thanks Vinny and Poper. Really appreciate your response.

The question is now how do we address these issues now?

Would it be advisable If she could get funds from her father into her account with an affidavit and letter stating the origin of funds (In the previous application, we didn't provide the letter from her father stating the origin of funds (GBP 1600) which resulted in refusal) ? If yes, then what other documents will be required from her father? Is there anything she can provide from her father's side to make her case stronger?

For clarity,
Here is the refusal letter:

Hi Vinnay, Poper

2) Please note that the above letter is submitted for the clarification, but also it means there are going to be two different sponsors ( a) sister based in UK b) father based in Pakistan). Is this going to be OK?

Thanks

In my view, a sponsor needs to supply reference letters from his/her employer, declare source(s) of income, tax returns. The applicant's father might need to furnish these details as well
