i applied for asylum in 2000 and was granted exceptional leave to remain in 2002 to 2003. i applied for extension in 2003 and was granted discreationary leave to remain till 2005. before my leave expired in 2005 i applied for extension and till now i am waiting for a decision. i have been told that my case is a legacy case. i trained as a nurse in this country but because i do not have my passport with me it has been very difficult to secure a job as all the employers say they cannot employ until they see my passport. i have a 2yr old son. my worry is, i will loose my nursing pin number if do not find work before the end of july, having studied for 3yrs to achieve it.

my question is
will i be considered under family or single person (i have sent my sons BC to be considered with my claim)?
can my MP do anything to help my case?
i am currently on income support, will it help my application?

That is not a specific requirement of the regulations relating to employers ensuring that they do not employ an illegal worker. But I recognise that you might struggle to provide the evidence needed to satisfy an employer.

I think you should ask, specifically, for confirmation in writing from the Home Office that you have so-called Section 3C protection, that is, the terms and conditions of the visa that bore a 2005 expiry date are still in force. That is, such visa effectively remains in force .... it is "treated as continuing".

Armed with such a letter from the Home Office, especially given that an employer can phone the Home Office employers' helpline if they feel the need, you should be able to obtain employment.
