New Guideline for Tier 1 Updated on 19/04 but with previous date

Post by moongesture » Thu Apr 19, 2018 11:04 pm

Just realised that a revised version of policy guidance is updated today at the following link but the date it should be used is from 10th of April-18.

https://www.gov.uk/government/publicati ... ur#history

Now the last time I saw the previous version (11/01) was yesterday and wondering how can someone follow a guideline (in this case 10/04) when it was not been published on that day!!

Guides might be updated with a little delay to reflect the most recent rule changes. Rule changes are always announced way in advance by HO and covered on the forum discussions :!:

The last SoC HC895, published on 15 March 2018, (ISBN 978-1-5286-0248-8) had nothing re: part 6A / Appendix A.

I also need to add that sometimes guides are updated only to provide more clarification on the existing rules in place

Important clarification:

"
Please provide the details of all employees who filled these jobs for the required 12 month period. The jobs must exist for at least 12 months. Within the same job, another worker can replace a worker who is employed for part of a year and then leaves the job, so that the employment as a whole adds up to 12 months. The hours of workers in 2 part-time jobs can be combined to add up to 30 hours a week or more and form the equivalent of one full-time job, as long as the 2 part-time jobs exist for 12 months. We consider full-time to be 30 hours per week / 120 hours per month. Each job will be assessed separately unless you indicate below that you wish to combine one job with another job.
"

Changed to:

some clarifications (new heading and split) have been made on page 17 and 18 of the new guidance, under the following headings:

Money from third party funds, including Venture Capital funds and money from a third party which has been held by you for less than 90 consecutive days ................................................................ 17
Money held by you .......................................................................................................................... 18

earlier it was like this:

Money from third party funds and Venture Capital funds ................................................................ 17

Hi Kaps84,

Please advise , If you made an application for ILR before the new guidance produce and you have claimed 120 hours per month for the employee is still valid or they may refused you because now they mentioning only 30 hour per week.

Senior members of the forum will be able to help you here with more precise advise.

However, as per my limited knowledge, the rules that apply to you are those when you applied for initial application and came under the said visa category. (seniors to correct me).

Even if the above statement is not correct, then also, rules that can apply to you are only those that were in force on the date of your application. New rules are only for new applicants.
