Hi,
I am on tier2 General visa and gonna be eligible for ILR in June, but I have a couple of question can any one explain it to me.I got tier2 extention in 2016 on SOC salary 30400 , my 2016-17 P60 showed 32800 and 2017-18 P60 34250,and now my employer increased my pay to 36000,but my company never inform home office that they increase my salary . If I submit May and June payslip along with2016, 17 and 2017, 18 P60 it's be OK or my company need to inform home office that they increase my salary. Many thanks
When was your salary increased and why?
Was the increase just for you or was it company wide?
P60 doesn't matter because UKVI has access to your HMRC records. The figures on the P60 wouldn't count because UKVI knows that there are allowances that you might earn that are not regular. So as it stands, your salary has increased from £30,400 to £36,000. Everything points towards your salary getting increased to meet ILR. Why this is not bad in itself, your sponsor should have notified UKVI through the SMS about the increase and stating the reason for the increase.
This is a common issue, and most people in similar situations usually get their application delayed while the company is audited for Tier 2 compliance.
Your sponsor must be able to prove that the salary increase was genuine and sustainable.
It is also possible that you might not have any issue. Only time will tell
I am not a lawyer and do not claim to be one. All my comments here are based on my opinions, experience and interpretation of the appropriate UKVI guidance documents and immigration rules.
