Hope you are doing well.
I am a consultant based out of Frankfurt Germany working at COMPANY ABC Germany since 15th Sep 2017. I was working at Company XYZ in the UK until 14th Aug 2017 and left from UK to Germany as a Tier 2 migrant on 14th Sep 2017. I am now looking to reapply for a tier 2 general visa with another employer in the UK.
Could you please let me know if I can apply for a UK Tier 2 General Work/Residence Permit visa once I have completed my cooling off period of 1 year on 14th Sep 2014 i.e. after 15th Sep 2018.
Specifics of my case:
· UK Tier 2 General visa sponsored by company XYZ in the UK with initial validity from 15th Apr 2016 until 30th Jun 2019
· Last trip back to UK from Frankfurt Germany on Tier 2 General visa on 07th Aug 2017 ( showing entry stamp at Heathrow with Tier 2 visa number written over the entry stamp)
· Employment completion with company XYZ in the UK : 14th Aug 2017
· Notification by Company XYZ in the UK to Home office of Employment Completion: 21st Aug 2017 ( as per curtailment letter received on mail)
· Germany D visa received at German Embassy at London on 13th Sep 2017 with validity starting from 14th Sep 2017
· Left UK as a Tier 2 migrant to Germany on 14th Sep 2017 ( immigration stamp on passport at Berlin International airport on 14th Sep 2017)
· Started work at company ABC in Germany on 15th Sep 2017 ( Employment letter from company ABC in Germany as proof and salary slips)
· Received German long term Blue Card Residence Permit valid from 27th Nov 2017 until 26th Nov 2021
· Received a UK Visit visa ( C Type) valid from 17th Jan 2018 until 17th Jul 2018
· Made first travel to UK on visit visa on 26th Jan 2018 (immigration stamp on visit visa). Subsequent visits to UK in Feb, March, Apr 2018
· UK Tier 2 curtailment letter received on 09th March indicating the UK tier 2 visa will be curtailed on 09th May 2018. It also indicated that as I have a visit visa valid until 17th July 2018, I can stay in the UK until 17th Jul 2018 as a visitor.
With that as background, could you please let me know
1. I am supposing I have to complete a 1 year cooling off to apply for a new Tier 2 General visa. As I had left UK as a Tier 2 migrant on 14th Sep 2017 and have sufficient evidences to prove that, can I consider that one year cooling off will get completed on 14th Sep 2018 and hence I can apply for a new Tier 2 General visa after 15th Sep 2018 without fear of getting rejected.
2. Will the visit visa have any effect on the new Tier 2 General visa. I am assuming that any visits made on a visitor visa has no impact on new tier 2 general visa as stamps clearly shows I made visits as a visitor. Moreover, I received all my tax returns from the UK since I left UK as a Tier 2 migrant and had my names taken off from local councils.
