PBS Dependent ILR short of days please advise

Post by SAIR_ILR » Mon Apr 23, 2018 3:08 am

This forum was so helpful to got my ILR, my wife visa extend and my daughters MN1 visa. Especially, Vinny and CR001.
I got ILR on 22/04/2015 and now a British Citizen.I'm in ned of help again for my wife.

My wife's 1st PBS dependen visa issued in India on 16/07/13 arrival date in Uk on 09/09/2013 and visa expiry on 14/05/15.

Then I extended again on PBS dependent as a Tier 1 general issue date 18/06/2015 in Uk and will expire on 18/06/2018.

Now my question is:
1. If I take the vissa issue date 16 July 2013 then the 5 years will be on 16 July 2018. Taking 28 days early application in to account she would be eligible to apply 19 June 2018. Is it correct?

2. Visa expiry is 18th June 2018. so, when shall I apply and what would be the best option for me?

Can you please advise seniors and moderators. I'm really in tense and don't know what to do now? Many thanks in Advance.

Apply by post before visa expiry and the ILR will be granted when the application is processed

Thank you so much Zimba88. Its really peace of mind. I really wonder at still little confusion for me as the visa will expire on 18th June and the qualify period is on 19th June before the 28 days earlier. so, If I apply say by 15th Junethen would it be acceptable. As According to 28 days earlier it should have been 19th June. I'm worring bythe fact that they count the date when the application submitted. Or shall I submit directly on 18th June in the morning. your advise will be highly appreciated. Many thanks

Thanks a ton zimba88. Then I will apply by June 13th/14th for her ILR. Now let me get ready all the other documents required for it. Just to make sure with you is it the SET (O) correct form for her ILR?

Also if there any complicated questions I find I will post here. Could you please do help me in this case.

Many many thanks again. You are a life saver

just a tip... if you use the online date calculator, like this https://www.timeanddate.com/date/dateadd.html
, the date on 28 days earlier would be 18 June. 😊

You are qualified to apply for ILR by June 18,2018 which coincidentally happens to be the date the visa will expire.

You can use premium appointment to get the ILR if you can bear the cost

Dear Ianrezy
Many thanks for your reply. Yes, I think it would be the best idea. Are you sure we are qualified on 18th June. Can you please double check for me and let me know. I will prepare for the premium then. It would be highly appreciated.

Also can you please share any primum success stories like this so that I can follow. However, I’m looking in the forum still didn’t get any. Many thanks again

Thanks Vinny, I'm really happy to see your posts. I just viewed your recent announcements regarding fees increment. ILR is £2297 now, it's crazy.

Lovely to see the success story, I think I'm going to do the same as apply by post and then Option (2) as per your guidance on success links provided. Just one questions Vinny, as per your experience in my case which option will be better: Premium appointment or apply by post and then option (2).

Dear Lanrezy,
I read your success story as below
indefinite-leave-to-remain/pbs-dependen ... l#p1608222

Can you please confirm you one thing did you apply by premimum service as a person directly as it says it took you 2 hours only. Your advice will be much appreciated.

Based on the information you provided.

When you add 5 Years to your visa issue date = 16 July 2018. See calculator below

https://www.timeanddate.com/date/datead ... =&ad=&rec=

When you subtract 28 days from 16 July 2018 = 18 June 2018. See calculator below

https://www.timeanddate.com/date/datead ... ad=28&rec=

I can assure you based on the calculator that you can apply for premium on the date of your Visa expiry. Anyone/moderator that have a different opinion can please clarify.

I applied through the premium.

Best of luck.

Dear Ianrezy

Thanks a million for this. this is so clear to me now. Yes, going for Premium then. 16th and 17th weekends so 18th on Monday. Hopefully they do not change my appointments as I read in the forum that someone got messages suddenly from HO that due to staff training they changed the appointment. Finger crossed.

Can you also please tell me is there any financial requirements like while I did my ILR had to show £20,000 + earning p.a. Is it the case here in my wife as well or no need as its on PBS dependent.

Even if they change your appointment, Home office will be able to consider your out of time application because it will have been no fault of yours.

Dear Ianrezy,
Thank you so so much. I understood now. For the clarification can you please read one more my details as below:
I got ILR on 22-04-2015 through Tier 1 (General) 3+2= 5 Years route.

My wife applied in India for entry clearence:

Visa category: Tier 1 ( general) partner
Issue date 16/07/1013 valid untill 14/05/15
Came to UK on 9/9/2013 i.e. after 1 month 25 days. total 56 days

Wife's visa extention:

Visa category: PBS Dependant Leave to Remain
Issue Date 18/06/2015 valid untill 18/06/2018

If I take her issue date then she will be eligible for ILR on 18/06/2018 before 28 days of her 5 years.
So, I will apply for her ILR through premium service on 18/06/2018

other requirements: Life in the UK test
English: Her degree taught in english in India which the UKBA calculator gives 10 points.
so, Degree original certificate, taught in english medium letter from University

Do I need UKNARIK letter for B1 as well?

Her bank statements for 6 months, relation is genuine and subsisting so adrees proof in joint name, NHS registration, Mortgage letter and councill tax in both name/water bill

MY British passport

Is there anything else Im missing?

Zimba88, Vinny, and Ianrezy ; Your clarification will be much appreciated. Many many thanks again.

Forgot to write:

Her total absence from the UK is below:

From LHR to INDIA
16/08/2016 to 15/10/2016 = 61 days in total that's it.

Hope, she won't have any absence problem.

Dear Zimba88, Vinny, Shinha and Ianrezy please read my previous post in details for clarification whenever you will be free and let me know.

If YES then I'm ging to apply for ILR by premium on 18/06/2018.

Hi everyone,

Can you please help me with the following again as I'm bit confused.

good news is my wife passed the life in the UK test.

Now for english language, She got a letter from university that her medium of instruction was english. Now I'm applying for UK NARIC red route and uploaded all the needed documents.

Just before making payment want to make sure from all of you that I'm doing the right one. as its cost £150.

1. I choosed the option Immigration tier as Family, Settlement, and Nationality
2. Immigration route settlement

Is it correct for ILR ?

and what certificate they will provide? is it just the english or both degree comparability as well. Can you please reply with your valuable suggestion. It would be highly appreciated. Many thanks

Dear all,

I'm just waiting for the NARIK Documents and rest all ready.

Just to clarify one thing from you all please guide.

1. I'm having child benefit only in my name, will this effect my wife's ILR?
2. My wife using child vouchers from her company, so which goes direct to child-minder before tax from her salary. Will this effect her ILR?

Please reply as soon as you get my message. I will be eagerly awaiting for this as this doesn't let me sleep well.
many thanks
