Indefinite Leave To Remain

Hi,

I am married to EEA national since Oct 2012 and have a 4.5 years old son together. Our marriage has been broken for some time and finally we have decided to file for divorce. However I am confused with certain thing I need help with.

I am eligible to apply for residence Card however I am trying to find out if i can file for divorce first instead of residence card and then file for ILR instead of residence Card.

I donot want to be married anymore so want to explore the option of divorce and then ILR or Residence Card.

Can anyone please advise. as I cannot get the straight answer out of anyone at this time.

Has the EEA national been working in the UK since Oct 2012, and do you have proof of that?
