I have some questions please answer me about that.I applied for my wife visa and home Office refused it then I did appeal.Appeal was allowed on human rights grounds. Then home office challenged court decision.Home Office appeal is granted for upper Tribunal.I have received a letter from upper Tribunal which is judge orders,According to this letter having considered the upper Tribunal’s grant of permission and the decision of the first tier tribunal in this appeal which was promulgated on 7 September 2017,my preliminary view is that the first tier tribunal judge inadvertently stated in its decision that the appeal was allowed when on any reading of the reasons,it’s intention was to dismiss the appeal. It is noted that there has been no cross appeal made by the respondent . Unless either party files a notice of objection to the course proposed below,within 14 days of the date this order is sent,I will set aside the decision of the first tier tribunal and dismiss the appeal and in doing so,adopt the reasoning of the first tier tribunal.
I am confused about this letter,someone told me that the home office appeal is dismissed and someone else told me that my appeal is dismissed. So please can you give me more information about this,I will be very thankful and I will appreciate it.
