MN1 Help

Post by clarendo » Fri Apr 27, 2018 9:01 am

Dear Forum,

This question has been more or less asked in the past here, but there's no definitive answer. So here's the situation :

I'm an EU citizen who has acquired permanent residence, with a child born in the UK before the permanent residency date. I'm trying to register the child using the printed form MN1 (child born in the uk with permanent residency derived from me). Regarding section 3 the guide clearly states:

SECTION 3: PARENTS’ RESIDENCE IN THE UNITED KINGDOM OR
THE BRITISH OVERSEAS TERRITORIES
If the application is for a child born abroad, to parents who are British citizens by
descent under section 3(2) or 3(5) you must complete this section, otherwise go
straight to Section 4: Good Character.

In the application though, within Section three, one can find the following :

Parent who is an EEA national exercising EC Treaty rights.
3.13 If one of the parents is an EEA national and is claiming to have permanent residence
since 30 April 2006, tick one or more of the boxes below to show the way(s) in which you have
exercised Treaty rights for the past 5 years and give the relevant dates:

Questions 3.14-3.16 also refer to EEA nationals. It seems to me that the guide is contradicting the application, so does anybody know whether I have to fill in questions 3.13-3.16 ?

In relation to that, question 1.3 asks:

State if and when the child was given indefinite leave to enter/remain in the UK. If the child’s parent is an EEA national, a Swiss national or a family member of an EEA or Swiss national you should ensure that they qualify for permanent residence.

I'm not sure what to fill in here. The child doesn't have a permanent residency card, as the right to register as a British citizen, derives from my settled status. Should I fill in the date I became settled, or should I leave this blank?

Thank you in advance
