ILR options after T4,PSW,T1E,T2PBSDependent

Post by rsrameshsunil » Fri Apr 27, 2018 11:38 am

its been a long journey so far, my situation as below:

Entered UK on 5th Sep 2009 on T4 Student (visa expiry 31 Oct 2010)
Applied for PSW 15 Oct 2010 (approved Same day with Expiry 14 Oct 2012)
Applied for T1 Ent (50K) on (Aug 2012)
-Got refusal letter on 01 Jan 2013 with Appeal Right
-Appealed within time and Court hearing succesfful April 2013
-Approval Letter received June 2013 (Tier 1 Ent - Valid until 1st June 2016)
Got Married abroad in 2015 and my spouse applied for Tier 1 Ent Dependent visa (approved with same expiry as mine)
Spouse entered UK late 2015 on above dependent visa
Spouse joined work in UK immediately.
Both left UK on 31st May 2016.
Spouse received Tier 2 general sponsorhip from above work and entry clearance applied and approved on 3rd week June 2016(validity 5 years - expiry 2021)
I applied as Tier 2 dependent and granted 5 years visa
We both came back 3rd week June 2016 and living here since then.(We were just out of country for few weeks- less than a month)

My questions are
1. what are the options? Do i qualify for 10 year long residence by 2019? or 2021 after my spouse completes 5 years?
2. Any other better options? (I am currently PBS dependent but lived here for ~9 years).
3. Since i have been on Tier 1 Ent, do i have to satisfy all investment requirements etc.. ?
4. Since i havent been on Tier 1 General, i haven't declared my earning with Home Office in any of previous applications, what can i do to ensure i dont get caught in any tax related ILR refusals as i am seeing in the forum?

Yes.

Yes.

earlier is ILR LR. if you have tax problem durjng TIER 1, PBS dependent route is safer.

3. Since i have been on Tier 1 Ent, do i have to satisfy all investment requirements etc.. ?

if you didn't, may have problem.

4. Since i havent been on Tier 1 General, i haven't declared my earning with Home Office in any of previous applications, what can i do to ensure i dont get caught in any tax related ILR refusals as i am seeing in the forum?

most people have problem with tax amendment. canbe refused as treated as not good character. Don't know your situation so cannot comment.

PBS dependent route should be safer in 2021.

Many thanks for your response. Regarding your view on point 3, in case they refuse due to this reason, what section would the refusal be? Just trying to understand legal reason for refusal here so i can ensure i handle all those areas before application.

Set(LR) is the best option for you. Your wife however will be better off to stay on Tier 2 route for her ILR in 2021
3. Since i have been on Tier 1 Ent, do i have to satisfy all investment requirements etc.. ?
No. But you might be asked to demonstrate that you always had access to the investment money during Tier 1E visa period
4. Since i havent been on Tier 1 General, i haven't declared my earning with Home Office in any of previous applications, what can i do to ensure i dont get caught in any tax related ILR refusals as i am seeing in the forum?
Tax amendement issue will not affect you
