Wife has right to abode

Post by simonwhu » Sat Apr 28, 2018 10:09 am

My wife, who is a Canadian, has a UK right to abode. She has lived in the UK since December 2007 and we have been married for 7 years.

Does she use the form AN to apply for British citizenship or does she do it another way. Also, does she have to take the Life in the UK test. There is no advice on the GOV Uk website as to what to do.

Do you know how she acquired her Right of Abode? When and where was she born? Was one of her parents born in the UK?

Her adopted father was born in the UK.

She was born in Montreal, in Canada in 1964. Right to abode granted in 2000.

I can't find the specific law that applied to adopted children at that point in time (1964), but I will go out on a limb and say that it is likely that as the adoptive (not adopted) father was a CUKC by birth in the UK, his adopted daughter would also have acquired CUKC status on adoption and hence that your wife (the adopted daughter) is already a British citizen by descent. She could apply for a British passport directly.

She cannot however automatically pass on the British citizenship to her own children.
