British citizenship application second attempt

Post by hyun » Wed May 02, 2018 10:38 pm

Hello, could I have some advice for my husband’s citizenship application please?

He’s a refugee and came to uk 2007. Got a ILR May 2013 and applied citizenship February 2015 but it was declined.
Because he illegally stayed between March 2013 and April 2013.
HO send him a letter saying that he’s eligible to apply again after May 2018( which is 5years from ILR issued)
So, here are some issues that I’m not sure about

1) does need to explain why he was declined at first attempt?

2) his travel document was expired 2012 and didn’t renew until 2015.
So, he needs to provide some other evidence to prove his residency requirements between 2012 to 2015.
He’s working since 2008 but doesn’t have all P60s.
He has only from 2014.
HMRC send a letter(work history?), it shows his previous and current companies and periods.
Will HMRC letter cover his residency requirements?
Or does he need more like all those years pay slip?

3) we went Palma de Mallorca after he got a new passport but he didn’t get the arrival stamp from airport. He only has departure stamp from Palma de Mallorca.
We contacted airline to provide evidence of his flight to Mallorca but they only send me a email to confirm not a paper letter.
Will this be a problem?
I didn’t keep the boarding pass.

Lastly, could anyone recommend good register office to use nationality checking service?

Thank you for reading

Best wishes everyone~

better to have a cover letter to declare this, although they should also have a record. Also include the decision letter of the first application that state your husband is eligible from May 2018.

2) his travel document was expired 2012 and didn’t renew until 2015.

His BRP should be sufficient to show that he is legally stay in the UK.

Employment is not a condition to grant citizenship. I used NCS and the worker didn't take my p60 and said this is not necessary as I consented the UKVI get information from HMRC. And I granted citizenship

3) we went Palma de Mallorca after he got a new passport but he didn’t get the arrival stamp from airport. He only has departure stamp from Palma de Mallorca.

Should be ok. UKVI has record of in and out of the country. So his passport is sufficient. Just like I went back to Hong Kong as I am also citizen there thus no stamp on my passport as well.

Will this be a problem?

It will be fine.

I didn’t keep the boarding pass.

That depends on where you live.

Not entirely correct. Till very recently (8th April 2015), there were no exit checks by UKV&I and therefore UKV&I will not have proof of a person leaving the UK.

Also see this template letter to include if your husband was a refugee and is being penalised for a period of illegality immediately after arrival in the UK, but was subsequently granted refugee or humanitarian protection.
