Tier 4 20h p/w work limit exceeded

Post by Nivesh11 » Thu May 03, 2018 9:19 pm

Hi,

I am on a tier 4 general student visa. I have got 2 jobs while at uni. Im in my third year and have 2 more years left at uni (including a placement year). I have noticed that for a particular week in january that I made a mistake in summing the time on my timesheets from the two jobs and the total amounts to 20.75 hours when it should have been 19.75 hours according to my start and finish time. The timesheets have been approved and I have been paid. Now, I have changed my course to include a placement year and I am having to go back to my home country to make a new visa application. Nobody contacted me about the breach( UKBA or Home office) Is this going to be a problem in getting a new visa?

And should I try to notify my employer to try to rectify the mistake? Should I call the home office or UKVI to inform them about my situation.

Any help would be much apppreciated.

Thanks
Nivesh

No, because you have always worked within the 20/hours a week maximum.

Even though you have not worked illegally, your employer appears to have not queried the timesheet that gave that impression, so it would be good to tell them, as a reminder of their obligation to prevent illegal working.

Plus, your employer has overpaid you, so you now have a debt to them. The honest thing would be to let them know about this and give them a chance to claw back the overpayment. However, this is not an immigration matter.

No. You have always worked within your restriction, you just messed up your timesheet so you have a debt to your employer.

Thanks a lot for the advice. The thing I'm worried is since i need to make a new tier 4 application and they are going to ask for my NI number. Is the 20.75h a week of work be an issue in getting the new tier 4 as I got paid for it and it appeared on my payslip as working 20.75h?

You already asked this same question, and I answered.
