Tier 2 dependent visa - absence

Post by waelayoub » Thu May 03, 2018 9:29 pm

Hi,
My wife currently on a tier 2 visa granted in Feb, 2017. She travelled back home in March and she is planning to stay until October which means she will exceed the 180 continues period. I read on the gov website and found "You must not include any absence from the UK during periods of leave granted under the Rules in place before 11 January 2018 towards the 180 days allowable
absences."
Does this mean that there is no limit on how many days she can spend abroad?

Your prompt response is really appreciated.

Section 319E

(d) not have been absent from the UK for more than 180 days during any 12 month period in the continuous period, except that:
(1) any absence from the UK for the purpose of assisting with a national or international humanitarian or environmental crisis overseas shall not count towards the 180 days, if the applicant provides evidence that this was the purpose of the absence(s), and
(2) any absence from the UK during periods of leave granted under the Rules in place before 11 January 2018 shall not count towards the 180 days.

the absence after 11 jan 2018 will count towards 180 days.
