Hi!
My situation is very complicated.
I had a verbal job offer 8 months ago and my company have not yet issued a contract. They told me that for that the rlmt must be done. And promissed me to wait 2 months. Then they told me that the process took more time than needed. Now I've waited all this months they have been assuring me that everything was good. And recently told me that rlmt was complete and that they were going to apply fir RCOS for May Panel. But recently the person applying told me that HR told her not to apply because they will be considering a european candidate. Exept that the rlmt is actually done and valide ! I contacted the managers about the issue but no one gave me any answer. yesterday the person told me that finally they were going to apply but that he won't have any high hopes as my rcos may be rejected. Now I don't have any proof that they have actually applied and my salary would have been through the quotas of last month so normally my chances are pretty good but they keep telling me that it might be rejected! Plus They still haven't sent me my contract!!
I am now very tired of waiting they are not answering my emails. I feel that I have been played and I don't know how can I get a proof that they've actually applied for rcos.
Thank you for your advice !

We probably aren’t the best people to ask for advice about this unfortunately because this is an immigration forum and it seems at the moment your biggest concern is more about recruitment with your employer.
You need to speak with a lawyer to see if you have any rights or whether it’s just bad luck. Unfortunately because you don’t have a contract or unconditional offer letter I feel it might just be rotten luck if they go for another candidate but you really need to discuss this with a lawyer because at the moment this seems to be a recruitment rather than immigration issue. The employers have all the responsibility of applying for RCoS so there’s really no way of you knowing whether they applied for you or not until the results come out. Good luck.

Have you been asked to make any payment?
How did you get the job? Phone interview or how?
I am not a lawyer and do not claim to be one. All my comments here are based on my opinions, experience and interpretation of the appropriate UKVI guidance documents and immigration rules.

I have applied on the company's website and it's a big company ont of the biggest in the world. I have been through all the online process I have sent all the documents they needed and they offered me a great salary and the managers were very responsive in the beginning but I heard from a friend who knows someone in the team that the HR are trying to block me because they don't want to go through the visa process. They have been delaying it so that the managers give up but they didn't because they wanted me in the team.
I have recently spoke to the manager and told him everything that's been going on with HR and he told me that he wasn't aware of all of that. rLMT has been finished but they were still giving him CV's of other european candidate to consider. And now that he knew he told them to apply for rcos yesterday. But they said they did it and that I should keep in mind that I might be rejected but my salary is > 50k and they still haven't sent me the written contract

It's the only company that accepted to give me a sponsorship in the beginning and they offered me a very good salary. It's very tough to find something in my field

I wish you all the best. It is not uncommon for HR to try to avoid going through visa process. You can only wait and hope for the best. I don't think you can do anything about this. It's more of an ethical and moral issue than legal. If they have offered you the job verbally, they should follow it up with written offer letter (subject to visa approval).
