Tier 2 general extension application followed by a new tier 2 general application

Post by ktyagi » Sun May 06, 2018 10:02 am

Hello all,

First of all apologies for the confusing topic title, I couldn't put down exactly what I wanted to say. But, think I can explain better here.

So I am up for tier 2 extension by the end of this summer, my employer will soon be getting a new CoS and I am planning to submit my application soon after that which will be around 2 months before my leave expires - think it should be straight forward.

However, I am on the look out for changing jobs and there happens to be 1-2 very exciting opportunities on the market at moment which I am thinking to apply. In my field it is will generally be slow taking 3-4 months from applying -to- interview -to- a successful offer -to- a new CoS. Of course, there is no guarantee that I will get an offer in the end, which is why I have to continue with the extension with my present employer.

So my question to all you insightful people is, how would it work? Can I apply for tier 2 extension with the present employer, then if I get the offer and apply for a new Tier 2 while the extension application would still be under review?

Thank you all,
Cheers.

Yes you can. But a bit tricky once your extension application in progress but your VISA expired. In this case, you are under 3C leave. However, if you file the other application, means you withdraw the extension application and your 3C leave shall ends and you become a person in the UK without valid leave thus overstay, in theory. Thus you cannot work once your file your new application because your 3C leave ends. I don't know if your 3C leave would also end if you just file the same Tier application. need input from the other as well.
