Desperately seeking advice on my impending appearance at tribunal courts . The deeds of the tail is a long one however i'll put key dates/info to help paint a picture
1. I got married to my portuguese husband in July 09
2. Application was denied reason stating "suspicious marriage". Both my husband and I got called in for an interview in July 10.
3. Residence Card issued August 10 following interview and stated that they have satisfied themselve of the genuinity of the marriage
4. Husband got sentenced to prison in Oct 10 and was released Nov 11
5. Marriage suffered strained and I moved out eventually in August 2012 but we maintained arelationship and tried to work on issues
6. Husband started becoming violent in 2013/14. I've been to the doctors serverally and was encouraged to go the the police and domestic violence centre. Police said case not serious enough and i should come back. Got advice from domestic centre
7. Following application for perminent residence which was refused, whilst waiting for appeal to be submitted. HO visited my house and found some male item of clothing which belonged to the father of my first child. Following that they claimed my marriage wasn't real and they have received intel. I think my husband did this out of spite. The HO have also not returned any of my original paperwork so i have little to no proof. Going to court soon and unsure of what to do.
Would anyone have any advice or have come across a case like this before? Will i be able to claim domestic violence as the reason for marriage breakdown even though I only have doctors report and contact from the local domestic shelter for women?
