Tier 1 Ent ILR Job Query

Hello Guys.
Hope everyone is doing good.

I have few questions Regarding Tier 1 Ent ILR.

My situation is:
50k (Pre-April 2014)

Initial Visa Granted = June 2013.
Extension Granted = October 2017.
ILR DUE = June/July 2018.

I Have three Full Time Employees working for my business currently.

1) Employee A FT = 130 Hours per month.
2) Employee B FT = 130 Hours Per month.
3) Employee c FT = 130/132 Hours per month.


All Employees are doing minimum 130 hours a month.

so my question is that if i calculate 30 hours per week than few months in a year there is a calculation of 138 hours. or some time less then 130 hours. As i am on pre-April 2014 Rules, i am getting confused about the calculation of hours, as i seen few rejections on job hours basis.


If I continue to employ 3 FT Employees minimum 130 hours per month than am I fulfill the Job Requirement for 24 months. OR
I have to calculate 30 hours per week specifically.

E.G:
For Example for the month of January 2018, there is 23 working days.

30 Hours Per week mean 6 hours per day. So it makes (23*6)138 hours for the month of January 2018, Rather than 130 hours per month.

You are overthinking this as this is not how job hour calculation is done.
A full time job is min 30 hours a week. A month on average is around 4.3 weeks which comes around 130 hours (4.3 x 30).
These assumptions are used to calculate the min 3120 hours required :!:

Simply calculate the weeks worked for the period you are claiming and multiply the number by 30 OR count the full months and multiply by 130. Ignore hours worked per day, ignore number of working days in a month, ignore hours more than 30 per week :!:

Assuming you are paying monthly, the CW takes the monthly salary in the FPS and divides it by the hourly rate you provide. If it is 130 or more, it is FT job.

As Zimba pointed out, don't overthink it.

Hello guys.

Thanks for your help like every time.

I have one question about ILR, In almost three to four weeks i am gonna apply ILR.

You have been: (a) registered with HM Revenue & Customs as self-employed, or (b) registered with Companies House as a director of a UK company or member of a UK limited liability partnership. The requirements above must have been met:
(i) within 6 months of entering the UK (if granted entry clearance and there is evidence to establish your date of entry) or, in any case within six months from the date your last leave was granted, and (ii) within the three months before the date of application

You do not need to provide evidence of (i) if you were awarded points for this in your last successful Tier 1 (Entrepreneur) application. You must still provide evidence of (ii).


As I am director of comapny and I applied my first Busniness visa inside country. i am confused about second point. which document i have to send for (ii) point.

You are giving job to your employees @ 130 hours/month. It means your total hours for the year will be 130*12=1560 for one employee
Let's do a weekly calculation as per HO guidance
As per HO guidance job @ 30 hours/week is considered full time.
As per HMRC or (HO), One year has 52 weeks so
52*30=1560 hours should be done by one employee in one year. HO wants 1560 hours to be done by one employee
So you are fine if you are giving job 130hours/month
For your second question
You must provide the CAR (current appointment report), not older than 3 months before the date of application

Where do you get this from ? There is no such criteria in the immigration rules or in the guidance or any other documents.
